On November 1, 2005, USCIS issued a Request for Evidence (RFE) to Petitioner.
On January 20, 2006, Petitioner submitted its response with attached evidence, which USCIS found to be insufficient, as asserted in its denial dated July 23, 2008.
USCIS denied Petitioner’s I-140 petition for two reasons: the first was because it found Petitioner to be acting as a “mere agent or office of a foreign entity abroad” as opposed to a company deemed to have been “doing business” for one year (defined as “the regular, systematic, and continuous provision of goods and/or services by a firm, corporation, or other entity”); the second reason being that it found that Petitioner “failed to establish that the proffered position qualifies as executive or managerial”.
With regard to both components of the USCIS's decision, Petitioner has presented compelling evidence to the contrary.I.
